1. Service provider and acceptance
These Terms govern your use of VivaCreo for Android, operated by REexcellent GmbH, Ottweilerstraße 15, 81737 München, Germany. By creating an account or using the application, you agree to these Terms, the Privacy Policy and the Legal Notice. Mandatory consumer rights remain unaffected.
The Android application is developed and maintained by Semy WEB GbR, which also supports its Google Play release and publishing operations.
2. Eligibility and account
You must be at least 18 years old and legally able to enter into this agreement. Provide accurate information, keep your credentials confidential and tell us promptly about suspected unauthorized access. You may not sell, transfer or share your account.
3. AI tools and results
VivaCreo provides image, video and audio generation and editing through probabilistic AI models. Results can be inaccurate, unexpected, biased or unsuitable. They are not professional, medical, legal or safety advice. Review every result before relying on, publishing or distributing it.
Features, models, settings, limits and availability may change. We do not promise uninterrupted service, a particular generation time or a particular result from a prompt.
4. Your content
You retain your rights in content you upload. You grant VivaCreo a limited, non-exclusive licence to host, copy, transmit and process that content only as needed to provide, secure and support the service, comply with law and enforce these Terms. The licence ends when the content is deleted, except for legal records and temporary backup cycles.
You confirm that you have all permissions required for images, audio, video, trademarks, prompts and likenesses you submit. Do not upload unlawful, harmful, intimate or deceptive content, or content involving a minor in a sexualized context.
5. Responsible use
You must not use VivaCreo to commit a crime, impersonate a person deceptively, infringe intellectual property, create non-consensual intimate imagery, exploit a child, facilitate violence, evade safety controls, attack the service or interfere with another user’s account. We may restrict or suspend access when reasonably necessary for safety, security or legal compliance.
6. Credits and purchases
Credits are usage units for eligible tools. The amount required is shown before generation where available. Subscription credits may expire at the end of their billing cycle; separately purchased credits follow the terms shown at purchase. A failed technical operation may release reserved credits after confirmation. Prices, taxes and applicable purchase terms are shown at checkout.
7. Availability and liability
To the extent allowed by law, VivaCreo is provided on an as-available basis and you are responsible for maintaining a compatible device, network connection and backups of anything you choose to keep. Nothing in these Terms excludes liability that cannot legally be excluded, including liability for intentional or grossly negligent conduct, injury to life, body or health, or mandatory consumer protections.
8. Ending use
You can stop using the application at any time and request deletion through Delete account. We may suspend or terminate access for a serious or repeated breach, security risk, legal requirement or discontinued service. Provisions that must survive termination, including payment, content permissions for existing legal records and liability terms, remain effective.
